HomeMy WebLinkAbout2026 Resolution No. 0091 RESOLUTION NO. 9 SERIES OF 2026 A RESOLUTION APPROVING ACQUISITION AGREEMENT, PERMANENT EASEMENT FOR PERMANENT PLACEMENT, CONSTRUCTION, OPERATION, AND MAINTENANCE OF SIDEWALKS, RAMPS, RETAINING WALLS, AND DRAINAGE MATERIAL FOR THE WEST DARTMOUTH MULTIMODAL SAFETY PROJECT WHEREAS, on July 24, 2024, the City of Englewood executed PSA-24-149 to engage Atkins Realis for design engineer services for the West Dartmouth Avenue Multimodal Safety Improvements project (the “Project”) and have since renewed the PSA twice; and WHEREAS, the Project will improve safety for all modes of transportation on West Dartmouth Avenue at South Tejon Street, including vehicle, bicycle, foot traffic, and bus transit by including ADA-compliant curb ramp replacement and accessibility upgrades, traffic signal replacement, and re-striping to implement new cross-section with buffered bike lanes; and WHEREAS, Steve Gulick and Amie Gulick own property adjacent to the Project; and WHEREAS, to construct a new traffic signal cabinet, the City is required to acquire a permanent easement from these parties for property located near W. Dartmouth Avenue and S. Tejon Street; and WHEREAS, in exchange for $4,740, which is based on the appraised value of the property, this permanent easement allows the City to construct improvements and access over and across the property for this necessary construction; and WHEREAS, City staff requests the City Council authorize an agreement regarding this transaction, and to accept both the easements and a deed for the parcel acquired. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. The City is hereby authorized to execute the Memorandum of Agreement with Steve Gulick and Amie Gulick to acquire a Permanent Easement for the West Dartmouth Multimodal Safety project. The agreement shall be in substantially the same form as that attached hereto as Exhibit A. Section 2. The Mayor, Mayor Pro Tem (in the Mayor’s absence), and/or City staff are hereby granted the authority to take all actions necessary to implement the provisions of Section 1 and 2 above.
